New Job

So nothing is officialy yet but I will most likely be getting a promotion to run our support desk.  I have so many ideas on how to run things better and take us to the next level.  I'm excited about the challenges but a little afraid.  I've never worked at this level before.  It's a bit intimidating.  Everyone seems to think that I'll do well.  I should find out next week when this will all be official and find out what the terms are going to be.  I'm not even sure if this is going to be a pay raise or not.  I really hope so but we've been in a freeze for over a year now so maybe not.  But I will take the experience and the title for my resume.

I'll keep you all updated...

We had a client with "environmental illness" and the tech who went to her house was not allowed to wear any cologne. This was quite serious for her. As far as your workplace, it sounds as if several people have somehow contracted this rare disorder. Good thing your company has made special provisions for them ;)

Are you a temp worker? Just wondering. Since they moved you from a "better" job, to one that doesn't pay as well, I think that could be construed as punishment for what occurred. Illegal. I'd still consult an attorney and see what your options are, but as someone said in the past comments, you should start looking for a new job, as even if you succeed in getting concesions or what not from this company, the well is poisoned, and they'll do their damndest to get rid of you one way or another. I'd also recommend talking to your boss and to HR before taking any legal action, and inform them that you feel they have established a hostile workplace environment for you and that the actions by HR and management could be seen as illegal. As such, you will seek legal advice if this environment is not changed. You have leverage, you just have to use it wisely.

It's not really illegal Soup. In all but two states you can get fired for having an ugly hairstyle if the employer wishes...It's employment-at-will. If there was a blatant offense like her boss asking for sex in exchange for a raise "or else" or something, that would be one thing...But it sounds like she trusted someone, and they stabbed her in the back...and based on the nature of the conversations had -she could actually be accused of sexual harrassment...It's stupid, and it doesn't make sense...But that's how it works.

Oh, I am all to aware of what "At-Will" employment is. But, I'm sorry TDrag, you are wrong. It is illegal to "retaliate". By their actions with the incident, and the knowledge they had of "J" spreading rumors regarding Durty, they fostered a "Hostile" work environment towards her. That is illegal. They took no actions to quash the rumor spreading of "J", nor did they try to find out Durty's side of the story. The fact that HR was involved makes it even more damning against them. I.E. - Unlawful harassment is a form of discrimination that violates Title VII of the Civil Rights Act of 1964 and other federal authority. Unwelcome verbal or physical conduct based on race, color, religion, sex (whether or not of a sexual nature and including same-gender harassment and gender identity harassment), national origin, age (40 and over), disability (mental or physical), sexual orientation, or retaliation (sometimes collectively referred to as “legally protected characteristics”) constitutes harassment when: 1. The conduct is sufficiently severe or pervasive to create a hostile work environment; or 2. A supervisor’s harassing conduct results in a tangible change in an employee’s employment status or benefits (for example, demotion, termination, failure to promote, etc.). Hostile work environment harassment occurs when unwelcome comments or conduct based on sex, race or other legally protected characteristics unreasonably interferes with an employee’s work performance or creates an intimidating, hostile or offensive work environment. Anyone in the workplace might commit this type of harassment – a management official, co-worker, or non-employee, such as a contractor, vendor or guest. The victim can be anyone affected by the conduct, not just the individual at whom the offensive conduct is directed. Harassment that results in a tangible employment action occurs when a management official’s harassing conduct results in some significant change in an employee’s employment status (e.g., hiring, firing, promotion, failure to promote, demotion, formal discipline, such as suspension, undesirable reassignment, or a significant change in benefits, a compensation decision, or a work assignment). Only individuals with supervisory or managerial responsibility can commit this type of harassment.

I'd also consider the possibility that your employer is trying to force you to quit. This is called a "Constructive Discharge" and is also illegal (if you do quit because of the enviroment towards you). “Constructive Discharge” is a legal term meaning that you actually quit your job, but if you meet certain standards then the legal system might treat your resignation as if you were actually fired without good cause. Being fired without good cause is an Adverse Employment Action required by many laws before you have a case, but a truly voluntary quit is not. Persons who voluntarily quit might not have strong legal rights, but persons who are “constructively discharged” might have strong legal rights in some circumstances. But be very very careful before you say “I quit” - get legal advice first.
