Did you feel burned by Hot Coffee?

It appears as though Take Two Interactive is ready to offer up some free cash for your 'blisters' and 'blindness'. A preliminary settlement of $35 will be offered to those that have proof of purchase in addition to stating that you or someone you loved was damaged by the hot coffee mod.

"The preliminary deal, if accepted by the U.S. District Court for the Southern District of New York, would end the suits against Take-Two and subsidiary Rockstar Games without any admission of liability or wrongdoing by the two companies, Take-Two said in a statement.

The lawsuits were filed over a controversial sex mini-game on “Grand Theft Auto: San Andreas” (GTA), discovered in 2005. A software modification that came to be know as the Hot Coffee mod unlocked the adult content, which otherwise could not be accessed."

As most of you know, the "Hot Coffee Mod" allow gamers to see explicit sex acts between the main character, CJ, and his "girlfriends" (hoes?). Did you lose sleep over this? Well now it looks like you can cash in too.

If you search the web for video of what is actually unlocked, or if you run the Hot Coffee Mod itself, you can see what is unlocked: character models in their default clothes, or at least some clothes, being run through a series of animation. Ho-hum -- not "explicit." The nude models and stuff are further modifications by the game's community, aren't they?

The minigame was a work-in-progress which was abandoned, *not* final code and art that was hidden, waiting to be unlocked. ESRB slapping Take2/Rockstar around for this is bogus, especially considering they're essentially ruling inconsistently compared to Manhunt 2's "AO" rated content, where mods have been applied to reinstate the explicit content.

In Manhunt 2's case the ESRB seems to be saying that Rockstar is not accountable for the unlocked content accessed through 3rd party applications, but in GTA: San Andreas' case, they're saying that they /are/ culpable.

The hot coffee mod ruined my life. My wife left me, I lost my job and I am shunned by my fellow townsfolk, but I saved a lot of money on my car insurance.

But seriously, this has to be the stupidest class action lawsuit ever. How in the world can anyone prove they have been damaged?

This just goes to show all that is wrong with this country. I'd bet money that this suit was filed with the idea in mind that instead of going through a lengthy, costly trial, the settlement was taken. Lawsuits just like this are brought up all the time with similar intentions. It's the sheer greed of a nation and the government officials that base their campaigns on false promises of working to abolish such frivolous lawsuits that allows anyone who sees any opportunity to play the victim for the most ridiculous reasons to net some cash.
